ORDER ADOPTING REPORT AND RECOMMENDATION Case No. 2:06CV242 DAK This matter is before the court on Plaintiff's Objection to the Magistrate's Report and Recommendation. On July 20, 2006, this case was referred to the Magistrate Judge under 28 U.S.C. § 636(b)(1)(B). On August 15, 2006, the Magistrate Judge held a hearing on Defendant eBay's Motion to Dismiss for Improper Venue or, in the Alternative, for Failure to State a Claim. On August 24, 2006, the Magistrate issued a Report and Recommendation, recommending that Defendant eBay's Motion to Dismiss based on improper venue be granted and that Defendant Ace Coin's Motion to Dismiss be granted. On August 31, 2006, Plaintiff filed an Objection to the Report and Recommendation, which the court has considered, along with the entire case file. Plaintiff has not cited any authority to suggest that the Magistrate's legal analysis was incorrect, and Plaintiff has not otherwise raised a valid objection to the Report and Recommendation. Having independently reviewed the file in its entirety and the case law that this court is bound to apply, the court finds that the Magistrate's analysis was entirely correct. Therefore, the Dockets.Justia.com Case 2:06-cv-00242-DAK Document 27 Filed 09/14/2006 Page 2 of 2 court hereby APPROVES and ADOPTS the Magistrate Judge's Report and Recommendation. Defendant eBay's Motion to Dismiss for Improper Venue is GRANTED. Plaintiff's claims against eBay are DISMISSED without prejudice. Defendant Ace Coin's Motion to Dismiss is GRANTED, and Plaintiff's claims against it are DISMISSED with prejudice. There is no evidence in the record that Defendant Robert Baganz was ever served with a Summons and Complaint, and therefore he is DISMISSED without prejudice.
