MEMORANDUM DECISION AND ORDER granting in part and denying in part 106 Motion for Partial Summary Judgment. The Court grants Trans-Western's Motion on its claims for declaratory relief, breach of contract, and quiet possession, but denies its request for an entry of damages at this juncture. Disputed material facts remain which preclude this Court from entering damages in this matter and the determination of damages will therefore be reserved for later proceedings.
