Such failure is a direct and proximate cause of any and all damage or other harm allegedly suffered by Google. TENTH AFFIRMATIVE DEFENSE (Lack of Privity) Google's First Amended Complaint, and each purported cause of action contained therein, is barred by lack of privity. ELEVENTH AFFIRMATIVE DEFENSE (Failure to Join) Google's First Amended Complaint, and each purported cause of action contained therein, is barred by Google's failure to join necessary and/or indispensible parties to the action.
