CONCLUSION With material facts in dispute preventing the court from determining whether Plaintiff was unlawfully seized and whether Defendants are protected by qualified immunity, and after finding that Plaintiff has not provided sufficient evidence regarding UPD liability, the court DENIES Plaintiff's summary judgment motion. Defendants' summary judgment motion regarding qualified immunity and UPD liability is likewise DENIED. In light of this opinion, the parties must file an amended proposed pretrial order within 20 days from the date of this order, confining the issues of fact and law to the briefperiod noted in the body of this opinion as being genuinely in dispute. ~ DATED this L- day of August, 2014. ~ ------ 29
