DEFENDANTS' THIRD MOTION FOR DISMISSAL WITHOUT PREJUDICE
AND SUPPORTING MEMORANDUM OF LAW
NOW COME the Defendants, by and through their respective counsel, and hereby
respectfully move the Honorable Court to dismiss this matter without prejudice. For
support, Defendants offer the following memorandum of law.
MEMORANDUM OF LAW
On April19, 2012, the Court ordered that Plaintiffhad ten (10) days (from that
date) "to submit a formal written response regarding his ability to proceed." Pursuant to
F.R.Civ.P. 6(a)(1)(B) and (C). Plaintiffs formal written response was due to the Court
on Monday, April30, 2012. A "PACER" check ofthe case's docket entries this date
showed that Plaintiff did not file the ordered response by Monday, April30, 2012.
Defendants again respectfully request that this case be dismissed for failure to
prosecute.
