ENTRY ORDER adopting 48 REPORT AND RECOMMENDATION recommending that Petitioner's 5 PETITION for Writ of Habeas Corpus and 40 MOTION for Transport Order be denied and denying as moot 57 MOTION for Preliminary Injunction and 60 MOTION f or Summary Judgment. The court declines to issue a certificate of appealability because Petitioner has not made a substantial showing of the denial of a constitutional right. See 28 U.S.C. § 2253(c)(2) (allowing for a certificate of appealability "only if the applicant has made a substantial showing of the denial of a constitutional right"). This case is DISMISSED.
