PLEASE TAKE NOTICE that on April 23, 2010, at 10:00 a.m., or as soon
thereafter as counsel may be heard, Rosetta Stone Ltd. (“Rosetta Stone”) will move the Court for
an order imposing sanctions against Google Inc. This motion for sanctions relates, in part, to
Rosetta Stone’s Motion for Partial Summary Judgment and Google’s Motion for Summary
Judgment, both of which also are scheduled to be heard on April 23, 2010, at 10:00 a.m.
