OPINION AND ORDER: Defendant National Action Financial Services, Inc. ("defendant") moves to transfer this action to the Western District of New York. Plaintiff Jonathan Tobey ("plaintiff') cross-moves to transfer this action to the Eastern District of Virginia. Plaintiff's 29 motion to transfer venue is granted and defendant's 24 motion is denied.
