ORDER- The Court ADOPTS, as its own, the findings of fact and recommendations of Judge Buchanan as set forth in her Report (Doc. 24). It is hereby ORDERED that plaintiff's motion for summary judgment (Doc. 14) is DENIED. It is further ORDERED that defendant's motion for summary judgment (Doc. 17)is GRANTED.
