On this day came the parties, by counsel, upon Defendants' Motion to Seal Certain Exhibits and Parts of Joint Claims Construction Brief [Docket No. 86] ("Motion to Seal"), and, it appearing to the Court that subsequent to the filing of the Motion to Seal, the Plaintiff filed a Response to the

Motion to Seal [Docket No. 98] representing that the information purportedly covered by the
Protective Order as "Confidential" need not be filed by seal, and, therefore, the Motion to Seal has been mooted and should be withdrawn; and, upon good cause shown it is
ADJUDGED, ORDERED and DECREED that the Motion to Seal filed by the Defendants on May 12,2008 is moot and deemed to be withdrawn; and

THE CLERK FURTHER IS REQUESTED to file the unredacted versions of Defendants'

Joint Opening Brief on Claim Construction and Exhibit 3 of the Declaration of Antonio R. Sistos in
Support of Defendants' Opening Brief on Claim Construction as public documents.
