DEFENDANT GOOGLE INC.'S MOTION AND MEMORANDUM IN SUPPORT OF MOTION FOR ENTRY OF AN ORDER RENDERING MOOT GOOGLE'S OBJECTION TO PLAINTIFF'S DESIGNATION OF DANA TODD AS A TECHNICAL ADVISOR UNDER THE PROTECTIVE ORDER Defendant Google Inc. ("Google"), by counsel, moves this Court for an order rendering Google's objection to Plaintiff Bid for Position LLC's designation of Dana Todd as a technical advisor under the Protective Order ("Google's Motion Objecting to Todd") as moot and deeming it withdrawn. In support of this motion, Google states as follows: 1. Google filed its Motion Objecting to Todd. Thereafter, the parties worked out a reasonable compromise that will mollify Google's concerns and protect its proprietary information from being disclosed to its competitors. 2. The parties have agreed to place the compromise in an Agreed Order in the form of the Proposed Order attached as Exhibit 1. Entry of the Agreed Order attached as Exhibit 1 will moot Google's Motion Objecting to Todd. 3. The parties are circulating the Proposed Agreed Order for endorsement and will file it with the Court as soon as possible.
