MOTION AND MEMORANDUM IN SUPPORT OF MOTION TO EXPEDITE
BRIEFING FOR I/P ENGINE’S MOTION FOR REVIEW OF JUDGE LEONARD’S
RULING ON I/P ENGINE’S THIRD MOTION FOR DISCOVERY SANCTIONS
REGARDING UNTIMELY DISCOVERY RESPONSES
Plaintiff I/P Engine, Inc. (“I/P Engine”) moves the Court to expedite briefing on
Plaintiff’s Motion for Review of Judge Leonard’s Ruling on I/P Engine’s Third Motion for
Discovery Sanctions.
Trial is scheduled to begin on October 16, 2012. Thus, a decision on the motion is
needed by that time. Under Local Rule 7(F)(1), Defendants’ response would be due after trial is
already underway. Consequently, I/P Engine requests that the Court expedite the briefing
schedule on I/P Engine’s Motion For Review of Judge Leonard’s Ruling.
I/P Engine contacted Defendants’ counsel to seek concurrence with an expedited briefing
schedule, but no agreement was reached. I/P Engine suggests that Defendants’ response be due
Monday, October 15, 2012 at noon. I/P Engine waives its reply, anticipating that any matters
warranting a reply can be addressed orally on the morning of October 16, 2012. A proposed
order is attached.
