This Court, having considered Plaintiff I/P Engine, Inc.’s Motion for Judgment Under
Rule 52(b) and for a New Trial under Rule 59, hereby ORDERS that the motion is GRANTED
as follows:
The Court’s findings on laches are hereby amended. The jury’s responses to question
III.C of the verdict form are hereby vacated and a new trial is ordered to determine the amount of
damages accrued from September 15, 2005.
