ORDER that: (1) The Plaintiff's 15 Objections to Magistrate's Report and Recommendation are overruled; (2) The 14 Report and Recommendation of the Magistrate Judge is adopted on the basis of the reasoning of the Report and Recommendatio n; (3) The Plaintiff's 10 Motion for Summary Judgment is denied; (4) The Defendant's 12 Motion for Summary Judgment is granted; and (5) The Commissioner's decision is affirmed.
