MEMORANDUM OPINION
This matter comes before the Court on Defendant Dominion Payroll Services, LLC's
("Dominion") Motionfor Summary Judgment, filed pursuant to Federal Rule of Civil Procedure
56.' (ECF No. 41.) Plaintiff Angela Georges responded, (ECF No. 54), and Dominion replied,
(ECF No. 57). The Court heardoral argument on May3, 2018. Accordingly, the matteris ripe
for disposition. The Court exercises jurisdiction pursuant to 28 U.S.C. § 1331.^ For the reasons
that follow, the Court will grant the Motion for Summary Judgment.
' Federal Rule of Civil Procedure 56(a) provides, in pertinent part:
(a) Motion for Summary Judgment or Partial Summary Judgment. A party
may move for summaryjudgment, identifying each claim or defense—or the part
of each claim or defense—on which summary judgment is sought. The court
shall grant summary judgment if the movant shows that there is no genuine
dispute as to any material fact and the movant is entitled to judgment as a matter
of law.
Fed. R. Civ. P. 56(a).
^ "The district courts shall have original jurisdiction of all civil actions arising under the
Constitution, laws, or treaties of the United States." 28 U.S.C. § 1331.
