MEMORANDUM OPINION Petitioner, David Matthew McKinney, a Virginia inmate proceeding pro se, petition for a writ of habeas corpus under 28 u .S. C. § counts of 2254 wherein robbery, he eight challenges his counts attempted of sentences for eight robbery, seven counts of use of a firearm in the commission of a felony, grand larceny, and conspiracy in the Circuit Court for Virginia Beach. On March 11, 2008, the City of the Court denied a § 2254 petition filed by McKinney challenging the above convictions. McKinney v. Ray, No. 3:07CV266, 2008 WL 652111, at *l, *3 (E.D. Va. Mar. 11, 2008).
