2.

Plaintiff’s Motion for Summary Judgment or in the alternative Motion to Remand
(dkt. no. 9) is hereby DENIED;

3.

Defendant’s Motion for Summary Judgment (dkt. no. 11) is hereby GRANTED;
and

4.

This case is hereby DISMISSED, striking it from the Court’s active docket.

The Clerk of the Court is hereby directed to send a certified copy of this Order to all
counsel of record and to United States Magistrate Judge Robert S. Ballou.
