THIS MATTER came on for consideration upon the Stipulation Re:

Consolidation with Case No. 12-CV-6-RMP, and it appearing from the file and

19

records of this Court in this case that good cause exists for Defendants Garvin

20

Kabernick and Donna Rae Kabernick to have their case consolidated with the

following lawsuit: Bruce P. Kriegman, Plaintiff, v. Theodore Schultz and Betty

Schultz, Defendants, Case No. 12-CV-6-RMP, on the grounds that the Court has

3

ordered the trials for these two cases to occur on the same day and on the parties’

4

agreement that the amounts in controversy and facts regarding these cases are

5

similar in nature.

Accordingly, IT IS HEREBY ORDERED that Plaintiff’s Motion to

7

Consolidate, ECF No. 25, and Motion to Expedite Hearing, ECF No. 26, are

8

GRANTED.

9

The District Court Clerk is directed to enter this order, consolidate 12-CV-

10

634-RMP with 12-CV-6-RMP, provide copies of this order to counsel, any pro se

11

defendants, and to Judge Frederick P. Corbit, and close Case No. 12-CV-634-

12

RMP.
