and DC ECF No. 13. Having reviewed the Report and Recommendation and all

relevant filings, and having found that good cause exists pursuant to the entry of an

Order of Dismissal in the Bankruptcy Court on September 17, 2013, and no

objection being filed by any party, this Court hereby ADOPTS the Bankruptcy

Court’s Report and Recommendation, ECF No. 13. Defendant Dover

4

Developments is the sole defendant named in this cause; therefore, this case is

5

hereby dismissed with prejudice with each party to bear their own attorneys’ fees

6

and costs. Any pending motions are denied as moot; any pending court dates are

7

stricken.

IT IS SO ORDERED.

The District Court Clerk is hereby directed to enter this Order and to provide
