Pursuant to the parties’ stipulation, the 15 Court will dismiss the action solely against Stephen Mize with prejudice and 16 without costs or attorney’s fees to any party. Fed. R. Civ. P. 41(a)(1)(A)(ii). 17 ALSO BEFORE THE COURT is the parties’ Stipulated Permanent 18 Injunction and Dismissal of Racheal Graham (ECF No. 118). Pursuant to the 19 parties’ stipulation, the Court will dismiss the action solely against Rachel Graham 20 ORDER DISMISSING DEFENDANTS MIZE, GRAHAM, AND OGDEN~ 1 1 with prejudice and without costs or attorney’s fees to any party. Fed. R. Civ. P. 2 41(a)(1)(A)(ii). 3 ALSO BEFORE THE COURT is the parties’ Stipulated Permanent 4 Injunction and Dismissal of Kurt and Chrisann Ogden (ECF No. 119). Pursuant to 5 the parties’ stipulation, the Court will dismiss the action solely against Kurt and 6 Chrisann Ogden with prejudice and without costs or attorney’s fees to any party. 7 Fed. R. Civ. P. 41(a)(1)(A)(ii). 8 9 Pursuant to each party’s agreement with Plaintiff, each defendant named herein has agreed to be enjoined from directly or contributorily infringing 10 Plaintiff’s rights in Plaintiff’s motion picture, including without limitation by using 11 the Internet to reproduce or copy Plaintiff’s motion picture, to distribute Plaintiff’s 12 motion picture, or to make Plaintiff’s motion picture available for distribution to 13 the public, except pursuant to lawful written license or the express authority of 14 Plaintiff. To the extent that any such material exists, Defendants agreed to destroy 15 all unauthorized copies of Plaintiff’s motion picture in his or her possession or 16 subject to his or her control. 17 ACCORDINGLY, IT IS HEREBY ORDERED: 18 1. All claims and causes of action against Defendant Stephen Mize are 19 DISMISSED with prejudice and without an award of fees or costs. 20 ORDER DISMISSING DEFENDANTS MIZE, GRAHAM, AND OGDEN~ 2 1 2. All claims and causes of action against Defendant Racheal Graham are 2 DISMISSED with prejudice and without an award of fees or costs. 3 3.
