Defendant Green Tree Servicing LLC’s Motion to Dismiss for Failure to State a

Claim (ECF No. 7). Plaintiff, acting pro se, filed a motion to dismiss stating that

16

the property which was the subject of this action was sold at auction, and the case

17

is now moot. As Defendants have neither filed an answer nor moved for summary

18

judgment, Plaintiff has an absolute right to voluntarily dismiss this case. Fed. R.

19

Civ. P. 41(a)(1)(A)(i).
