BEFORE THE COURT is the parties’ Stipulated Motion to Dismiss with

Prejudice (ECF No. 31). Although the motion requests dismissal pursuant to

Federal Rule of Civil Procedure 41(a)(2) and (c), the Court construes the filing as a

16

stipulation of dismissal pursuant to Rule 41(a)(1)(A)(ii). Pursuant to the parties’

17

stipulation, the Court will dismiss this case with prejudice and without costs or

18

attorney’s fees to either party. Fed. R. Civ. P. 41(a)(1)(A)(ii).
