Pending before the Court are Plaintiff’s Motion for Voluntary Dismissal,

17 ECF No. 44, and Defendant’s Motion to Dismiss, ECF No. 34. Previously, the
18 Court declined to rule on the motions to permit the parties to enter into a long-term
19 settlement agreement. The parties recently notified the Court that they have
20 entered into a loan modification agreement, which resolves the dispute underlying
21 the litigation. The Court finds good cause to grant Plaintiff’s Motion for Voluntary
22 Dismissal.

Accordingly, IT IS HEREBY ORDERED:

1.
Plaintiff’s Motion for Voluntary Dismissal, ECF No. 44, is
25 GRANTED.

2.
Defendant’s Motion to Dismiss, ECF No. 34, is DENIED, as moot.

3.
The above-action is DISMISSED.
