Previously, the 18 Court declined to rule on the motions to permit the parties to enter into a long-term 19 settlement agreement. The parties recently notified the Court that they have 20 entered into a loan modification agreement, which resolves the dispute underlying 21 the litigation. The Court finds good cause to grant Plaintiff’s Motion for Voluntary 22 Dismissal. 23 Accordingly, IT IS HEREBY ORDERED: 24 1. Plaintiff’s Motion for Voluntary Dismissal, ECF No. 44, is 25 GRANTED. 26 2. Defendant’s Motion to Dismiss, ECF No. 34, is DENIED, as moot. 27 3.
