Before the Court is Magistrate Judge John T. Rodger’s Report and

16 Recommendation to Close File. ECF No. 5. The Plaintiff has not responded to a
17 court order to proffer the full filing fee, show cause why such prepayment would
18 be inappropriate, or submit a properly completed Application to Proceed In Forma
19 Pauperis.

After reviewing the Report and Recommendation and relevant authorities,

21 the Court finds the Magistrate Judge’s findings are correct. Therefore, the Court
22 adopts the Report and Recommendation in its entirety and orders the file in this
23 matter be closed.

Accordingly, IT IS HEREBY ORDERED:

1. The Court ADOPTS Magistrate Judge Rodger’s Report and

26 Recommendation to Close File, ECF No. 5, in its entirety.

2. Any pending motions are dismissed as moot.
