On October 18, 2016, the parties filed a Proposed Order of Dismissal, ECF

No. 12, which the Court construes as a Motion to Dismiss. A Notice of
13
Settlement, ECF No. 10, was filed by the Plaintiff notifying the Court that
14
settlement had been reached. The Court then issued an order directing the parties
15
to file a joint status report advising if settlement had been completed and directing
16
the parties to alert the Court when they would seek the case dismissed. ECF No.
17
11. Consistent with the parties’ agreement and Federal Rule of Civil Procedure
18
41(a), IT IS HEREBY ORDERED:

The parties’ Motion to Dismiss, ECF No. 12, is GRANTED.

All claims are DISMISSED WITH PREJUDICE, with all parties
to bear their own costs and attorneys’ fees.

All pending motions are DENIED AS MOOT.

All hearings and other deadlines are STRICKEN.

The Clerk’s Office is directed to CLOSE this file.
