Before the Court is Magistrate Judge John T. Rodger’s Report and

15 Recommendation to Close File that was filed on December 2, 2016. ECF No. 4.
16 Plaintiff did not file a timely response to the Report and Recommendation.
17 Additionally, Plaintiff has not responded to a court order to proffer the full filing
18 fee, show cause why such prepayment would be in appropriate, or submit a
19 properly completed Application to Proceed In Forma Pauperis.

After reviewing the Report and Recommendation and relevant authorities,

21 the Court finds Magistrate Judge Rodger’s findings correct, adopts the Report and
22 Recommendation in its entirety and orders the file in this matter be closed.

Accordingly, IT IS HEREBY ORDERED:

1. The Court ADOPTS Magistrate Judge Rodger’s Report and

25 Recommendation to Close File, ECF No. 4, in its entirety.

2. Any pending motions are dismissed as moot.
