21 the Court agrees with Magistrate Judge Rodgers’ findings and adopts the Report
22 and Recommendation in its entirety.

Accordingly, IT IS HEREBY ORDERED that:

5 GRANTED.

3. Plaintiff’s Motion for Summary Judgment, ECF No. 14, is DENIED.
