Defendant-Appellants are represented by John D. Munding, Ralph E. 22 Cromwell, Jr., and Jofrey M. McWilliam. Plaintiff-Appellee-Trustee is represented 23 by Pamela M. Egan. The motion was heard without oral argument. 24 On appeal, the United States court of Appeals for the Ninth Circuit stated, 25 “[t]his case is remanded to the district court with instructions to further remand to 26 the bankruptcy court. Limited jurisdiction is transferred to the courts below for the 27 sole purpose of settlement finalization and approval. [The Ninth Circuit] otherwise 28 retains jurisdiction over this matter and appeal.” ECF No. 35. Accordingly, this ORDER REMANDING MATTER TO BANKRUPTCY COURT # 1 Case 2:21-cv-00159-SAB ECF No. 37 filed 09/06/23 PageID.958 Page 2 of 2 1 Court remands the above-captioned matter to Bankruptcy Court for the sole 2 purpose of settlement finalization and approval. 3 Accordingly, IT IS HEREBY ORDERED: 4 1. Plaintiff-Appellee-Trustee’s Motion to Restore Limited Jurisdiction to 5 the Bankruptcy Court for the Sole Purpose of Settlement Approval, ECF No. 36, is 6 GRANTED. 7 2. The above-captioned matter is REMANDED to U.S. Bankruptcy 8 Judge Frederick P. Corbit for the sole purpose of settlement finalization and 9 approval. 10 IT IS SO ORDERED.
