Accordingly, IT IS HEREBY ORDERED:

1. The Court ADOPTS Magistrate Judge Rodger’s Report and
3 Recommendation to Dismiss, ECF No. 85, in its entirety.

2. The parties’ Stipulated Motion to Dismiss, ECF No. 83, is GRANTED.
5 The Court makes no award of costs or attorneys’ fees.

3. Plaintiff’s Motion for Summary Judgment, ECF No. 70, is DISMISSED
7 AS MOOT.

4. Defendants’ Motion for Summary Judgment, ECF No. 78, is
9 DISMISSED AS MOOT.

IT IS SO ORDERED. The District Court Executive is hereby directed to
11 enter this Order and forward a copy to Petitioner and counsel. The District Court
12 Executive shall close this case.
