Plaintiff, a pre-trial detainee at the Washington State Penitentiary proceeding pro

16

se, filed a complaint pursuant to 42 U.S.C. § 1983 against state and federal officials for

17

unlawful prison conditions and continued detention. Plaintiff also seeks damages for his

18

unlawful confinement following his capture in U.S. waters by State of Washington

19

officials. Because the acts complained of occurred in Walla Walla County, which lies

20

within the venue of the Eastern District of Washington, see 28 U.S.C. § 128(a), venue

21

properly lies in that district and not in this one. See 28 U.S.C. § 1391(b). Accordingly,

22

this case is TRANSFERRED to the United States District Court for the Eastern District of

23

Washington. See 28 U.S.C. § 1406(a).
