Movants failed to meet and confer with Plaintiff before filing their renewed motion to sever or dismiss (Dkt. No. 192), due to an oversight by the below-signing attorney, who failed to recollect that the Court had ordered the defendants to meet and confer prior to renewing their motion to sever or dismiss: "Defendants may refile the motions or file amended motions to sever after they have reviewed the amended complaint and infringement contentions and met and conferred." (Dkt. No. 149 at 2.). Movants met and conferred today with Plaintiff's counsel in a good faith but unsuccessful effort to reach agreement or narrow the dispute, but the parties were unable to agree, and Plaintiff opposes the renewed motion to sever or dismiss.
