Defendant AOL Inc. (“AOL”) respectfully joins in the Renewed Motion to Dismiss or

Sever for Misjoinder Pursuant to Fed. R. Civ. P. 20 and 21 (Dkt. No. 193) filed by defendant

Yahoo! Inc. (“Yahoo”). AOL requests that the Court dismiss or sever it from this action for the

21

reasons set forth in Yahoo’s renewed motion.

AOL adopts and incorporates Yahoo’s explanation and application of the principles of

23

joinder reflected in Fed. R. Civ. P. 20 and 21, together with the case law and other authorities

24

illuminating those principles. (See Dkt. 193, 4-11.)

The Court has granted the defendants 20 minutes total for argument at the hearing on April
25, 2011, and in filing this motion AOL does not seek to alter that allotment. The undersigned
