Plaintiff Interval Licensing LLC (“Interval”) and defendant Google Inc.

respectfully move under Local Patent Rule 124 for an order authorizing Interval to

18

serve amended infringement contentions on Google Inc.

Consistent with the Court’s scheduling order, Interval served infringement

20

contentions on all defendants on December 28, 2010. Subsequently, counsel for

21

Interval and for Google held a meet and confer session and exchanged emails

22

addressing a number of concerns that Google raised about the infringement

23

contentions.

amended infringement contentions February 10, 2011. Both Interval and Google

25

now agree that these February 10, 2011 amended contentions should supersede the

26

contentions served in December.

Local Patent Rule 124 requires leave of Court to serve amended infringement
contentions after the deadline established in the scheduling order. Interval therefore

respectfully requests that the Court enter an Order authorizing service of these
amended infringement contentions as of the date of this motion. Google has no

objection and joins in this motion.
