16 of United States Magistrate Judge James P. Donohue and Plaintiff’s objections thereto, the
17 governing law, and the balance of the record, does hereby find and ORDER:

The Report and Recommendation is ADOPTED;

(2)
Defendants’ motion for summary judgment on all claims (Dkt. 40) is GRANTED;

(3)
Defendants’ motion to strike portions of plaintiff’s submissions (Dkt. 49) is

GRANTED;
(4)
Plaintiff’s motion to strike defendants’ declarations (Dkt. 50) is DENIED; and
