Donohue and Plaintiff’s objections thereto, the 17 governing law, and the balance of the record, does hereby find and ORDER: 18 (1) The Report and Recommendation is ADOPTED; 19 (2) Defendants’ motion for summary judgment on all claims (Dkt. 40) is GRANTED; 20 (3) Defendants’ motion to strike portions of plaintiff’s submissions (Dkt. 49) is 21 22 GRANTED; (4) Plaintiff’s motion to strike defendants’ declarations (Dkt. 50) is DENIED; and 23 ORDER GRANTING SUMMARY JUDGMENT IN FAVOR OF DEFENDANTS -1 1 2 3 (5) The Clerk of Court is directed to send copies of this Order to the parties and to Magistrate Judge James P.
