15 record, does hereby find and ORDER:

(1) The Report and Recommendation is adopted.

(2) This 42 U.S.C. § 1983 civil rights action is DISMISSED with prejudice under 28 U.S.C.

§ 1915(e)(2)(B)(iii).

(3) Mr. Richeson’s application to proceed in forma pauperis is DENIED as moot.

(4) The Clerk of the Court is directed to send copies of this Order to Mr. Richeson and to
