The following minute order is made by the direction of the court, the Honorable
James L. Robart:
The court has received the parties’ joint motion to reset the evidentiary hearing
19
and oral argument previously scheduled for Tuesday, November 21, 2017. (Joint Mot.
20
(Dkt. # 116); 11/13/17 Min. Order (Dkt. # 115).) Because counsel for both parties have
21
preexisting scheduling conflicts (see Joint Mot.; Morrison Decl. (Dkt. # 117); Lowney
22
Decl. (Dkt. # 118)), the court finds good cause to move the hearing to Wednesday,

December 13, 2017, at 9:00 a.m. and GRANTS the parties’ joint motion (Dkt. # 116).

Each party will have 75 minutes to present evidence regarding whether a force majeure
3
event precluded Defendant Rainier Petroleum Corporation (“Rainier”) from complying
4
with Paragraph 7(f) of the Consent Decree (“Paragraph 7(f)”) (Dkt. # 100) and whether
5
Rainier has substantially complied with Paragraph 7(f). The parties must file witness and
6
exhibit lists no later than Friday, December 8, 2017, at 5:00 p.m. After the presentation
7
of evidence, the court will hear argument from counsel. In addition to other issues the
8
court may address, the court DIRECTS the parties to be prepared to discuss Rainier’s
9
actions towards compliance with Paragraph 7(f) since the time the parties briefed the
10
11
motion.
