Dkt. #57. These cases, originally filed in 2015, have been plagued with delays 17 18 and stipulated continuances. In March of 2020, after a sixteen-month period where no status 19 report was filed, the Court set a case schedule with a deadline for summary judgment in March 20 of 2021. Four days before that deadline, the parties stipulated to an extension of time. The 21 Court has now granted four such extensions. Each stipulation contained minimal information 22 23 24 about the status of this case, and progress has apparently been glacial. The Court finds good cause to grant the instant unopposed Motion for a sixty-day 25 extension of the summary judgment deadline given the continuing efforts of the IRS to respond 26 to Microsoft’s concerns via letter and efforts to engage in negotiations. However, this will be 27 28 ORDER GRANTING FIFTH CONSENT MOTION REGARDING CASE SCHEDULE - 1 Case 2:15-cv-00369-RSM Document 58 Filed 01/28/22 Page 2 of 2   1 2 the last extension absent a more substantial showing of good cause or the scheduling of a telephonic status conference. 3 Having considered the briefing from the parties and the remainder of the record, the 4 Court hereby finds and ORDERS that the parties’ Fifth stipulated Motion to Amend the Case 5 6 7 8 9 Schedule, Dkt. #57, is GRANTED. The remaining deadline for the filing of IRS’s motion for summary judgment is extended up to and including March 29, 2022, for both of the abovecaptioned cases.
