Donohue, 16 United States Magistrate Judge, and the remaining record, does hereby find and ORDER: 17 (1) The Court adopts the Report and Recommendation. 18 (2) Defendant's motion for summary judgment (Dkt. 21) is GRANTED. 19 (3) Plaintiff’s amended complaint (Dkt. 11) and this action are DISMISSED with 20 prejudice pursuant to 28 U.S.C. § 1915(e)(2)(B)(ii).
