The Court, having reviewed Plaintiff’s motion to voluntarily dismiss, defendant’s 13 response, defendant’s motion for summary judgment, the Report and Recommendation of United 14 States Magistrate Judge Brian A. Tsuchida, and the remaining record, does hereby ORDER: 15 (1) The Court adopts the Report and Recommendation. 16 (2) Plaintiff’s motion to voluntarily dismiss (Dkt. 14) is GRANTED but the 17 dismissal is with prejudice. All pending motions, including defendant’s motion 18 for summary judgment (Dkt. 12) are denied as moot. 19 20 21 (3) The Clerk of Court is directed to send copies of this Order to plaintiff and to Judge Tsuchida.
