The Court ADOPTS the Report and Recommendation. 16 2. Petitioner’s motion for voluntary dismissal without prejudice pursuant to Federal Rule of 17 Civil Procedure 41(a)(2), docket no. 16, is GRANTED. 18 3. Respondents’ motion to dismiss, docket no. 11, is DENIED as moot. 19 4. Petitioner’s habeas petition and this action are DISMISSED without prejudice. 20 5.
