The Court, having reviewed plaintiff’s complaint, plaintiff’s request to withdraw his

complaint, defendant’s motion for summary judgment, the Report and Recommendation of the
16
Honorable Mary Alice Theiler, United States Magistrate Judge, any objections thereto, and the
17
remaining record, does hereby find and ORDER:

(1)
The Court adopts the Report and Recommendation;
19
(2)
Plaintiff’s request to withdraw his complaint (Dkt. 26) is DENIED;
20
(3)
Defendant’s motion for summary judgment (Dkt. 19) is GRANTED, and
21
plaintiff’s complaint (Dkt. 5) and this action are DISMISSED with prejudice. The Clerk shall
22
count this as a dismissal under 28 U.S.C. § 1915(g); and
