It is therefore ORDERED: 17 (1) The Court adopts the Report and Recommendation; (2) This case is DISMISSED with prejudice for failure to exhaust administrative 18 19 remedies; and 20 (3) The Clerk shall direct copies of this Order to all counsel and to Judge Theiler. 21 1 22 23 Nancy A. Berryhill is now the Acting Commissioner of Social Security. Pursuant to Rule 25(d) of the Federal Rules of Civil Procedure, Nancy A. Berryhill should be substituted for Acting Commissioner Carolyn W. Colvin as the defendant in this suit. The Clerk is directed to update the docket, and all future filings by the parties should reflect this change.
