NISSAN NORTH AMERICA, INC., and NISSAN MOTOR CO., LTD., Defendants. 17 18 Plaintiffs Tamara Lohr and Ravikiran Sindogi (“Plaintiffs”) and Defendant Nissan North 19 America, Inc. (“NNA”) (collectively, the “Parties”) enter into this stipulation with reference to the 20 following facts and recitals: 21 On May 16, 2022, this Court granted summary judgment in favor of NNA (Dkt. 211). 22 On October 12, 2022, and pursuant to Federal Rule of Civil Procedure 54(d) and Western 23 District of Washington Local Court Rule 54(d), NNA filed a motion for costs (Dkt. 218). 24 The Parties met and conferred regarding their previous agreement to consolidate discovery in 25 this action along the Johnson, et al. v Nissan North America, Inc. matter, a related case venued in the 26 Northern District of California, No. 3:17-cv-00517-WHO. 27 28 STIPULATION AND ORDER CASE NO.: 2:16-cv-01023-RSM SHOOK, HARDY & BACON L.L.P. 555 Mission Street, Suite 2300 San Francisco, CA 94105, Tel: 415.544.1900 Case 2:16-cv-01023-RSM Document 223 Filed 11/01/22 Page 2 of 4 1 The Parties now seek to resolve the issue of NNA’s attorney’s fees, costs and expenses 2 without further litigation on terms just and fair to all parties and hereby enter into the following 3 Stipulation of Attorney’s Fees, Costs and Expenses (“the Stipulation”). 4 THEREFORE, THE PARTIES HEREBY STIPULATE TO THE ENTRY OF AN ORDER 5 AS FOLLOWS: 6 1.
