Plaintiff Microsoft Corporation and Defendant Triple C, by and through their respective
counsel of record, hereby stipulate and agree as follows:
1.

Pursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii), this action and all claims in this

action are hereby dismissed with prejudice and without fees or costs to either side.
2.

The parties ask the Court to retain continuing jurisdiction over this matter solely

for the limited purposes of enforcing the injunction entered into in this matter and to enter

22

judgment in the event of a default by Defendant in the installment payments pursuant to the

23

terms of the parties’ settlement agreement.
