Plaintiff J. R. Simplot Company (“Plaintiff” or “Simplot”) and defendants

Washington Potato Company (“WPC”), Oregon Potato Company, (“OPC”), and Frank

Tiegs (“Tiegs”) (WPC, OPC, and Tiegs, collectively, “Defendants”) stipulate and agree as

20

follows:

On April 14, 2017, this Court granted Defendants’ Motion to Dismiss Amended

22

Complaint for Lack of Subject Matter Jurisdiction (Dkt. No. 49). See Order Granting

23

Defendants’ Motion to Dismiss (Dkt. No. 110). The Clerk of the Court did not enter a

24

judgment in this matter. Plaintiff and Defendants request that the Court direct the Clerk of

25

the Court to enter a judgment in this case.
