Defendants BizIgnition Technologies, Inc., Roger Hardy, and Nicholas Bozikis

(collectively, the "BizIgnition Defendants"), Defendant Winston Cabell ("Cabell"), and

Plaintiff Microsoft Corporation ("Microsoft") (collectively, the "Parties") jointly and
20
respectfully request that the Court extend the Trial Date and all related dates except the
21
mediation deadline by four months.

The Order Setting Trial Date and Related Dates (Dkt. No. 23) was entered on July 6,
23
2017. The BizIgnition Defendants moved to substitute counsel on September 25, 2017. Dkt.
24
No. 28. The Court granted that motion on the following day. Dkt. No. 29. The Parties request
25
this extension so replacement counsel can continue its familiarization with the facts and
26
circumstances of the case, including the ongoing discovery efforts by the Parties. Further, the
27
Parties request this extension to facilitate their continuing good faith efforts toward settlement

of this dispute, including continuing efforts to coordinate a mediation date at the end of April

or early May 2018. Thus, for the foregoing reasons, the Parties request that the trial date of

October 15, 2018, be extended by a period of four months (according to the Court's availability)

and all related dates except the mediation deadline be continued accordingly, with the proposed

dates as follows:
