STIPULATED MOTION TO DISMISS
1.

Plaintiff, United States of America, and Defendants, Debbie Appleby, Apple One,

LLC, Apple Two, LLC, and Apple Three, LLC, (the “Parties”) jointly move for the dismissal of

16

this proceeding under Federal Rule of Civil Procedure 41(a)(2).

2.

On March 3, 2017, Plaintiff the United States of America filed a Complaint in this

action to enforce provisions of the Fair Housing Act, 42 U.S.C. §§ 3601 et seq.
3.

On September 6, 2017, the Parties entered into the attached Settlement Agreement

20

resolving all issues that were raised in the United States’ Complaint. In consideration of, and

21

consistent with the terms of the Agreement, the Parties jointly move the Court to dismiss the

22

lawsuit with prejudice, subject to the terms of the Settlement Agreement of the Parties, which is

23

attached hereto.
