WELLS FARGO, et al., Defendants. 13 14 This matter comes before the Court on the motion to dismiss under Fed. R. Civ. P. 15 12(b)(6) of defendant Duke Partners II, LLC. Dkt. # 10. Plaintiff has not opposed defendant’s 16 motion to dismiss, and the Court considers such a failure to be “an admission that the motion has 17 merit.” Local Civil Rule 7(b)(2). The Court has also reviewed the record in this matter and 18 finds that plaintiff’s claims against Duke Partners II, LLC are both waived and insufficiently 19 pled. Defendant’s motion is therefore GRANTED, and plaintiff’s claims against Duke Partners 20 II, LLC are hereby DISMISSED with prejudice. 21 Dated this 31st day of May, 2017. 22 23 A 24 Robert S.
