This matter comes before the Court on the motion to dismiss under Fed. R. Civ. P.

12(b)(6) of defendant Wells Fargo Bank, N.A. Dkt. # 6. Plaintiff has not opposed defendant’s
16
motion to dismiss, and the Court considers such a failure to be “an admission that the motion has
17
merit.” Local Civil Rule 7(b)(2). The Court has also reviewed the record in this matter and
18
finds that plaintiff’s claims against Wells Fargo Bank, N.A. are barred by res judicata and also
19
insufficiently pled. Defendant’s motion is therefore GRANTED, and plaintiff’s claims against
20
Wells Fargo Bank, N.A. are hereby DISMISSED with prejudice.
