Plaintiff Costco Wholesale Corporation (“Costco”) and Defendants LG Electronics, Inc.

and LG Electronics USA, Inc. (together, “LGE”), by their respective attorneys, hereby stipulate

and agree, pursuant to Local Civil Rules 7(d)(1) and 10(g), as follows:

Costco and LGE are the only parties remaining in this action.

Costco and LGE have entered into a confidential written settlement agreement.

Therefore, pursuant to Federal Rule of Civil Procedure 41(a)(2), the above-

entitled action, including all claims asserted therein, shall be dismissed with prejudice.
